Importantly, the resolution includes reserve funds for surface transportation authorization that will allow for additional undesignated spending for transportation and infrastructure projects on the condition that the Highway Trust Fund continues to fully meet its obligations. Due to the current state of the Highway Trust Fund meeting this requirement could prove itself difficult.
Additionally, the resolution allows point of order in the Senate against any legislation that would raise taxes (including for the Highway Trust Fund) whenever the national unemployment rate exceeds 5.8 percent, meaning 60 votes or more would be required to pass such a measure, as opposed to a simple majority.
